Apologies, had to repost due to word censoring messing up. Always afraid of those community guideline strikes
Why coulsnt they just ban the "loli" crap.
I love anime but hate the constant pedo bs i hope manga writers see this and start making less fan service with little girls its. very concerning and i dont watch anime that do this it makes me sick. But then again i do hate cencirship as well so idk
More BS under the “protect the children!” cry. Anything to keep from having to actually parent your children. How about checking out the media they are consuming? No? Too much work? Got it.
What about the Light Novel, Chivalry of a Failed Knight, and they see Stella in lingerie?
Is bro defending child porn?
BIG SUS
An animated kid is still a kid. If you’d beat it to a fake one you’d beat it to a real one, if not worse
Fuck you dude. From the bottom of my heart
The problem with the Supreme Court getting involved simply is they’re willing to back whatever Donald Trump and the Republicans have done so simply waiting for it to go to the Supreme Court would be a waste of time if you don’t wanna see this happen call your representatives in Texas
I can see this falling through REALLY quick if handled properly if an individual gets hit by this "law". If a member of the manga/comic community gets attacked with this, and makes the issue public enough legal funding will be a moot point with the amount of people who will be ready to go to bat with their wallets to help fight this.
If it's the 🌽, good.
Now move on to the 🌽 consumers.
Big mouth fans are gonna be upset about this one
While it's definitely something to keep an eye on, after looking up what penal code 43.21 actually says and prohibits I doubt it's actually going to have as wide an effect as people are thinking. For anyone interested I'll include the direct verbage at the bottom of my comment. It'll DEFINITELY ban any sort of hentai, but your average anime will more than likely be just fine.
Texas Penal Code – PENAL § 43.21. Definitions
Current as of January 01, 2024 | Updated by FindLaw Staff
(a) In this subchapter:
(1) “Obscene” means material or a performance that:
(A) the average person, applying contemporary community standards, would find that taken as a whole appeals to the prurient interest in sex;
(prurient. adjective. pru·ri·ent ˈpru̇r-ē-ənt. : marked by or arousing an unwholesome sexual interest or desire.)
(B) depicts or describes:
(i) patently offensive representations or descriptions of ultimate sexual acts, normal or perverted, actual or simulated, including sexual intercourse, sodomy, and sexual bestiality; or
(ii) patently offensive representations or descriptions of masturbation, excretory functions, sadism, masochism, lewd exhibition of the genitals, the male or female genitals in a state of sexual stimulation or arousal, covered male genitals in a discernibly turgid state or a device designed and marketed as useful primarily for stimulation of the human genital organs; and
(C) taken as a whole, lacks serious literary, artistic, political, and scientific value.
(2) “Material” means anything tangible that is capable of being used or adapted to arouse interest, whether through the medium of reading, observation, sound, or in any other manner, but does not include an actual three dimensional obscene device.
(3) “Performance” means a play, motion picture, dance, or other exhibition performed before an audience.
(4) “Patently offensive” means so offensive on its face as to affront current community standards of decency.
(5) “Promote” means to manufacture, issue, sell, give, provide, lend, mail, deliver, transfer, transmit, publish, distribute, circulate, disseminate, present, exhibit, or advertise, or to offer or agree to do the same.
(6) “Wholesale promote” means to manufacture, issue, sell, provide, mail, deliver, transfer, transmit, publish, distribute, circulate, disseminate, or to offer or agree to do the same for purpose of resale.
(7) “Obscene device” means a device including a dildo or artificial vagina, designed or marketed as useful primarily for the stimulation of human genital organs.
(b) If any of the depictions or descriptions of sexual conduct described in this section are declared by a court of competent jurisdiction to be unlawfully included herein, this declaration shall not invalidate this section as to other patently offensive sexual conduct included herein.
Court analysis says without changes it will be ruled unconstitutional in federal court.
I’m generally pretty conservative but leave my anime alone!!! I need it for my sanity
Good ol Texas. Wouldn't expect less from the last state to hold slaves, still uses the death penalty, reduced the age of consent from 18 to17 a few years ago, still spanks kids in school, is trying to put the 10 commandments in classrooms, and silence gay teachers from even speaking about having a partner, and recently suggested black people should come back to the fields after their racism deported the hard working immigrants.
What an evil place.
For a bit of context, drinking in public became a jailable offense to get "drunk homeless people" off the streets, but now it is used to arrest people sitting on their own porch drinking a beer, or standing outside a bar having a smoke. Just because a law is made for one reason, it does not mean it will not be used for many more reasons, usually to impose fines for state, county, or city revenue.
First they ban weed then they ban anime. CAN’T WE JUST GET HIGH AND WATCH ANIME IN PEACE??? We’re not hurting anybody!!!
If the law / rule does go through as everyone fears, and this is my current worry, especially Crunchyroll and Sony don’t fight it are they gonna have to move out of Texas and California in terms of their offices because hello they got offices in both locations as they do move out those locations and then just close shop there would that solve their issue or is this gonna be a statewide thing?😢
Well, then explains why translations on some TV shows for programs like Crunchyroll haven’t come into effect in a couple of months & are still only in subtitles
Honestly the part that I really hate about this is it could also effect Gundam because several Gundam titles have kids and young adults piloting warmachines, child soldiers basically. If I’m understanding this all correctly Gundam falls under this thing’s jurisdiction. Meaning Gundam plastic models are on the chopping block.
Thank fucking god! Maybe now these studios will stop being weird as fuck!
You can thank ANTIFA for this and other extreme reactions.
Leftist Socialists Brown Shirts got a response, happy now you got attention.
Its written in such a broad way on purpose. Thats why censorship is so scary. Because laws aren't going to be specific because thats how they control the speech. If its specific that means theres no grey area loopholes they can exploit to get people on technicalities.
I was molested by a creepy quack doctor when I was still in middle school.
To those of you who are fundamentally misunderstanding the threat this bill poses, let me explain it to you.
Would this law have stopped it from happening if it was active at that time? Is this law going to prevent any kids from being victimized by predators? No. Pedophiles don't want drawings, they want kids. And only kids. In fact, pedophiles would very much support this bill because it takes police resources away from tracking down and arresting them for CSA and CSAM, instead directing it to people over fucking fictional drawings. How does that protect kids? Let me go further with a hypothetical question. There is a rapist attacking someone, and there is also a drawing of a rape, but you can only go after one of them. What do you do? The way the bill is written, it let's the rapist go to continue their crimes by only going after the drawing.
As if that wasn't ass backwards enough, the bill is so loosely worded anything some powermad turbo boomer morality larper doesn't like can be filed under it. "Looks like a child?" Even if the character in question is 18 or older? And what does that mean? Short? Flat chested? I suppose the Texas police are going to have to start rounding up midgets and Asians for the crime of existing under this law, then. What about the Bible too? Weren't there underaged people engaging in sexual activity in it? What about all the naked cherub statues and art? Are we going to arrest everyone who goes to a church with that kind of painting and put them on the sex offender registry? What about the Simpsons, Bigmouth, Family Guy, the book Lolita, the movie Hard Candy, there's so much this law is going to cover. "But it's only talking about the AI CP, bro!!!!" That's cope. Reread the bill. It's so loosely worded it can be used to go after anything. "It's only going after certain hentai genres, anime is fine." Reread the bill. Anything that may even kinda sorta be considered sexualizing anything that some crusty geriatric who forgot their dementia meds on the Texas legislature applies, and if you really trust them to know the difference between anime and hentai you are straight up as delusional as them. "This is a good thing because anime bad!!!!!!!" Obvious cope aside, you're saying that because of your own personal butthurt and nothing else. If something you like gets banned, you can't cry about it then since you like this law so much, janny. If this bill doesn't get pimpslapped into non-existence by the supreme court (which is exceedingly likely because of how vaguely written and overreaching it is, to the point where even if Trump said yes the bill would still get axed), many more states are going to copy this and possibly make it even worse.
The last and most odious part of this is that the Texas legislature has the sheer audacity to claim that it's for "protecting the kids." Bull fucking shit son, you don't give even a particle of a shit about the kids, you only made this law out of your personal butthurt and nothing else. If you want to protect the kids so much, why is the state age of consent 17, there exists child marriage laws, and you can have child beauty pageants in this state? Protecting kids. Shove it up your fucking ass, then go eat some Taco Bell so you can also blow it out, protecting the kids, you're protecting nothing but your fucking feelings to the point you'd rather turn people into state sex offenders than stop pedophiles. GTFO of here.
While free speech might protect people, and I very much hope that you're right, it's not like the US hasn't had laws that restricted free speech before. The development Hay's code is a good example of this; while not a bill in itself, it was created to self-regulate the industry in response to several censorship bills that put pressure on them. It took ~20 years for the supreme court to intervene and we're still seeing ripples of its effects in the industry to this day.
And let's not forgot how all of the "anti communist" laws during The Red Scare allowed the US to criminally punish anything they deemed as communist propaganda, which was applied very broadly and liberally.
I don't want to be too quick to assess the situation, and I'm hoping that dealing with similar laws in the past will set a precedence for how quickly the supreme court will intervene.
But the fact that this law was so unanimously passed is very frightening.
I can't believe that some kinds of draw are forbidden in Texas. That doesn't make no sense at all. It's not a a photograph, it's just a draw. They are censoring art. Will they forbid hand drawn picture too?
Make VPNs great again
EVERYONE'S HARD DRIVE CAN NOW BE CONFISCATED WITHOUT A WARRANT !!!!!!!!!!!!!!!!!!!!!! FREEDOM OF SPEECH, PROTECT CHILDREN, CLEAR OUT YOUR FANTASY ART FILES, FURRIES BEWARE, THEY ARE COMING AFTER YOU ALSO !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
Finally
Unsafe for a moment that they really do primarily focus on simply blocking pornographic content of underage characters, full stop.
I'm pretty comfortable with that, though when it comes to content that is animated or AI generated, like I still find it freaky and gross as hell, but no one was physically hurt, and it doesn't affect anyone else. So long as it is kept the hell away from me and others, I don't care. If someone out there is placated by having such content, that means they're less likely to go after someone real, and I'm fine with that.
Is the reason against such possession to help people in the community, or because people think it's gross?
This is an honest question. I don't like or ever in hell, want to interact with anyone consuming such content, but if you can give them something harmless to keep them away from real minors, wouldn't that be a good thing?
But why are all the anime kids dressed in skimpy stuff? I completely support the bill
Simple solution. Stop making anime for weirdos
Why are Japanese animators making kids to suit perverts?
This is a good thing. Anime caters to a weird crowd
The japs infiltrated the USA with they animo waifus is a psyop jk
I am not surprised this is happening in Texas, I really am not.
Texas banned it? Bro texas is leading the country in homicides and child abductions. No wonder it's not safe in texas, they focused on tv only young people watch🤦🏾♂️🤦🏾♂️
That law is about AI created CP. Not about anime 🤦🏻♂️
And look at that 3 weeks later and no anime bans gasp yall internet lawyers need to actually take a law course or learn to read.
Let them, make them tip there hand. Let them show exactly what kind of despots they are. In the mean time, grow TF up and quit watching cartoons.
Bet it's with the influx of AI image generators..
This is fucking insane
Idc ban all the loli shit, start forcing them to make all anime characters 18+. We dont need pedo bait ruining anime anymore. If you are against them banning under 18 characters from being sexualized then you're just a pedo.
I dont care. I will keep my dragon ball manga
So is the Netflix show "Ginny & Georgia" allowed to stream in Texas? Is there a loophole that if it's "child on child" stuff that flies pass the radar of the Texas bill? Because it's got alot of depicted underage sex happening. But because it's not an adult with an underage person, does the Texas Senate not care?
